Notes for Wendell OVERACKER
Notes: Will of Wendell Overacker of Danube, Herkimer County. Made on 13 Aug
of 1817 and proven on 19 Jan 1818.
In the name of God amen, I Wondel Overacker of the town of Danube in the County of Herkimer and the state of New York considering the uncertainty of the mortal life and being of sound mind and memory thanks be to God, do make this my last will & testement and in the manner and form following, that is to say, First, I give and bequeath unto my son Jacob Overacker the farm in which he now lives, it being lot number fifteen, to have and to hold to him & to his heirs and assigns forever on condition that he perform what shall be hereafter maintenance. Second, I give and bequeath unto Daniel Overacker, John Overacker, William Overacker, Elizabeth Overacker, Polly Overacker, Hannah Overacker & Sally Ann Overacker the children of my son John, deceased, the farm on which I now live to have and to hold to them & their assigns forever after they respectively attain the age of twenty one and it is my will and pleasure?and I order and direct that Phebe Overacker the wife of my son John, deceased, shall have her support for and during her life from and out of the said farm--Third, I give and bequest unto my daughter Elizabeth Near my bed and bedding & bedstead, forthly, I give and bequeath unto my son William Overacker all my clothing and the chest wherein I keep my clothing and three books printed in German. Fifth, I give and bequeath unto my son Daniel Overacker, two hunderd and fifty dollars to be paid by my son, Jacob in two years after my decease and provided my son Daniel should die before me or within two years after my death, then the said two hundred and fifty dollars are to be paid by my son Jacob to the children of my son Daniel & their heirs. Sixthly, I give and bequeath to my son William Overacker and to his heirs and asigns, two hundred and fifty to be paid by my executors herin named out of the estate I have divised to the children of my son John, two years after my decease, Seventhly, I do order and direct that all my debts be paid and lastly I do heareby nominate and appoint Cornelius Delong & John Deusler executors of my last will and testament hereby revoking all former wills by me made, In witness where of I have hereunto set my hand and seal this thirtheenth day of August in the year of our Lord one thousand eight hundred and seventeen, Signd sealed and published by the above named testator to be his last will and testamintation in presence of us who have hereunto subscribed our names in presence of the testator John Jenkins,, Daniel W.
